ভূমিকা:  আমরা কিছু শর্ত সাপেক্ষে সার্ভিস প্রদান করে থাকি। আপনি NameEver অর্ডার করছেন মানে এই শর্তগুলো মেনে নিচ্ছেন। অর্ডার দেয়ার আগে দয়াকরে শর্তগুলো মন দিয়ে পড়ুন। এখানে জানতে পারবেন আমরা কারা এবং কিভাবে সার্ভিস প্রদান করছি। কেন আমরা এই শর্তগুলো দিচ্ছি? কিভাবে আমাদের সাথে যোগাযোগ করবেন এবং কিভাবে গুরুত্বপূর্ণ তথ্য ও সাহায্য নিবেন। NameEver এই শর্তাবলীর যেকোনো অংশ পরিবর্তন, সংশোধন, যোগ বা অপসারণ করার অধিকার সংরক্ষণ করে, এবং তা কোনো পূর্ব নোটিফিকেশন ছাড়াই। পরিবর্তনগুলি সাইটে পোস্ট করা হলেই কার্যকর হবে, অন্য কোনো নোটিস প্রদান করা হবে না। দয়া করে নিয়মিত এই শর্তাবলী পরীক্ষা করুন আপডেটের জন্য। শর্তাবলীর পরিবর্তন পোস্ট করার পর আপনি যদি সাইটটি ব্যবহার অব্যাহত রাখেন, তা হলে এর মানে হল আপনি ঐ পরিবর্তনগুলি গ্রহণ করেছেন।

১. ক্রয় বিক্রয়:

কোনও পণ্য অর্ডার করার আগে এই শর্তগুলি সতর্কতার সাথে পড়েন। এই শর্তগুলি আপনার এই শর্তগুলিতে আবদ্ধ হওয়ার সাক্ষী।

২. ডেলিভারি সময়সীমা:

আমাদের ওয়েবসাইটে প্রদর্শিত সকল প্রোডাক্ট গ্রাহক চাইলে অর্ডার করতে পারেন। গ্রাহক তার পছন্দের ডোমেইন নামটি অর্ডার করার পর যদি ওই ডোমেইন অ্যাভেলেবল থাকে তাহলে সক্রিয়ভাবে ২4 ঘণ্টা মধ্যে গ্রাহকের ক্লাইন্ট এরিয়াতে তার ডোমেইন নামটি রেজিস্ট্রেশন করে দেওয়া হবে। হোস্টিং ক্রয় করার সাথে সাথে গ্রাহকের নিবন্ধিত ইমেইলে হোস্টিংয়ের যাবতীয় তথ্য পাঠিয়ে দেওয়া হবে।

৩. মূল্যফেরৎ নীতি:

আপনার হোস্টিং পরিষেবাগুলি বাতিল করতে এবং অর্থ ফেরত পেতে, আপনি যে নির্দিষ্ট পরিষেবাগুলি বাতিল করতে চান তার কার্যকর তারিখ থেকে 7 দিনের মধ্যে আমাদের সাথে যোগাযোগ করতে হবে ৷ শুধুমাত্র নতুন কেনা হোস্টিং ফি ফেরতযোগ্য। সেট আপ, SSL সার্টিফিকেট, ডেডিকেটেড আইপি, পুনর্নবীকরণ অর্থপ্রদান, সম্পদের সাথে অপব্যবহারের কারণে স্থগিত করা হয়েছে এবং অন্যান্য এককালীন ফি ফেরতযোগ্য নয়। আমরা যদি আপনার সাইট স্থানান্তর করি তাহলে আপনার রিফান্ড থেকে সাইট ট্রান্সফার ফি কেটে নেওয়া হবে। যদি আপনার ব্যান্ডউইথ ব্যবহার 5 জিবির বেশি হয় তাহলে মানি ব্যাক নীতি প্রযোজ্য হবে না। কোনো VPS/ডেডিকেটেড সার্ভার এবং ডোমেন রেজিস্ট্রেশনের জন্য রিফান্ড/মানি ব্যাক নীতি প্রযোজ্য নয়। কোনো প্রচারমূলক অফার/মূল্য ফেরতের জন্য প্রযোজ্য হবে না।

অনুপযুক্ত বা অবৈধ কার্যকলাপ. যদি আপনার অ্যাকাউন্টে বেআইনি কার্যকলাপ, অবৈধ mp3 ফাইল, পাইরেটেড সফ্টওয়্যার, হ্যাকার প্রোগ্রাম, ওয়ারেজ প্রোগ্রাম বা অন্য কোনো অবৈধ ফাইল পাওয়া যায়, তাহলে আপনার অ্যাকাউন্ট অবিলম্বে স্থগিত করা হবে। আপত্তিকর বিষয়বস্তু অপসারণ করতে ব্যর্থ হলে আপনার অ্যাকাউন্টটি বন্ধ হয়ে যাবে। এক্ষেত্রে কোন মানি ব্যাক গ্যারান্টি বা মূল্যফেরৎ প্রযোজ্য হবে না।
মানি ব্যাক রিকুয়েষ্ট পাওয়ার ৭ কার্যদিবসের মধ্যে টাকা ফেরত দেয়া হবে।

৪. পণ্যফেরৎ নীতি :

শেয়ারড হোস্টিং, প্রিমিয়াম হোস্টিং বা কর্পোরেট হোস্টিং , রিসেলার হোস্টিং , ভিপিএস প্ল্যান বাতিল করতে পারেন। বাতিল করতে সাপোর্ট এ যোগাযোগ করুন। অথবা মাই একাউন্ট থেকে ক্যান্সেল রিকুয়েস্ট করুন। ২4 ঘণ্টা মধ্যে সার্ভিস বাতিল হয়ে যাবে। সক্রিয়ভাবে সার্ভিস বাতিল করার পর সকল ডাটা ডিলিট হয়ে যাবে।

দ্রষ্টব্য: ডোমেন রেজিস্ট্রেশন, ডোমেন ট্রান্সফার, হোস্টিং সহ ফ্রি ডোমেন, যেকোনো ধরনের অফার প্ল্যান, রিসেলার হোস্টিং, মাস্টার রিসেলার হোস্টিং এবং ম্যানেজড ভিপিএস-এর জন্য ক্যান্সেল বা বন্ধ করা যাবে । রিফান্ড পাওয়া যায় না। আপনার অ্যাকাউন্টে ক্রেডিট ফেরতযোগ্য হতে পারে না ।

৫. বিক্রয়োত্তর সেবা :

আমাদের সার্ভিস অথবা প্রোডাক্ট হস্তান্তরের পর সার্ভিস এর মেয়াদ উত্তীর্ণ হওয়া পর্যন্ত সার্ভিস এর শর্তাবলী ও
চুক্তিপত্র অনুসারে আমরা পরিপূর্ণ সাপোর্ট দিয়ে থাকি।

৬. সার্ভিস অর্ডার :

৬.১ আমরা কিভাবে অর্ডার গ্রহণ করি?
অর্ডার করার পরে অবশ্যই সার্ভিসের মূল্য আগে পরিশোধ করতে হবে তারপর আমরা সার্ভিস প্রদান করবো। ওয়েবসাইটে অর্ডার দিচ্ছেন তবে আমরা আপনার অর্ডার একসেপ্ট করবো তার গ্যারান্টি দিচ্ছি না। আমরা আপনার তথ্য যাচাই বাছাই করে আপনার অর্ডার একসেপ্ট করবো। আপনি যদি ভুল তথ্য দেন তাহলে আপনার অর্ডারটি বাতিল করা হবে এবং আপনার টাকা ফেরত দেয়া হবে।
৬.২. একাউন্ট তৈরীঃ
অর্ডার করার আগে অথবা অর্ডার করার সময় একাউন্ট তৈরী করতে হবে। নাম, ঠিকানা, ইমেইল, ফোন নাম্বার ও পাসওয়ার্ড দিয়ে রেজিট্রশন করতে হবে। আপনার পাসওয়ার্ডটি গোপন রাখুন। অন্য কোন ব্যাক্তি আপনার একাউন্ট লগিন করছে এমন সন্দেহ হলে দ্রুত আমাদের সাথে যোগাযোগ করবেন।

৭. ডোমেইন :

৭.১. ডোমেইন কেনার পরে আপনার মেইলে ভেরিফিকেশন মেইল যাবে, মেইলে ভেরিফিকেশন লিংক যাবে। লিংকে ক্লিক করে ভেরিফাই করে নিন। ভেরিফাই না করলে ডোমেইন সাময়িকভাবে বন্ধ হয়ে যেতে পারে।
আপনার ডোমেইন NameEver ক্লায়েন্ট এরিয়া থেকেই মেনেজ করতে পারবেন। Whois তথ্য ঠিকমত প্রদান করবেন। ভুল তথ্যের কারনে আপনার ডোমেইন বন্ধ হয়ে যেতে পারে। সেক্ষেত্রে হোস্ট নীল দায়ী থাকবে না।

৭.২. রেজিট্রি কোম্পানি পরিবর্তনঃ বেস্ট সার্ভিস প্রদানের জন্য আমরা কোন নোটিশ ছাড়াই রেজিট্রারার পরিবর্তন করতে পারি। আপনি রিনিউ চার্জ প্রাদানের পরে যদি ডোমেইন ট্রান্সফার মেইল যায়, তবে অবশ্যই এপ্রুভ করবেন। এই পরিবর্তন আপনার ডোমেইনে কোন প্রভাব ফেলবে না।

৭.৩. থার্ড পার্টি পরিষেবা শর্তগুলোঃ সমস্থ gTLD গুলা ICANN এর অনুমোদিত রেজিট্রারার কোম্পানি থেকে রেজিট্রশন করা হয় ও ট্রান্সফার করা হয়। আপনাকে ICANN এর পরিষেবা শর্তগুলোতে একমত হতে হবে। আমরা রেজিট্রি কোম্পানি থেকে রেজিট্রেশন করি তাই তাদের পরিষেবা শর্তগুলোতেও একমত হতে হবে।

৭.৪. আপনার পছন্দের ডোমেইনটি খালি নাও থাকতে পারে। সেক্ষেত্রে অন্য ডোমেইন দেখুন। আমাদের সাইট রেজিট্রি কোম্পানির সাথে কানেক্ট করা। ডোমেইন রেজিট্রেশন, ট্রান্সফার ও রিনিউএর জন্য আমদের ওয়েবসাইট রেজিট্রি কোম্পানির কাছে প্রেরণ করে। রেজিট্রেশন, ট্রান্সফার ও রিনিউ করার পরে Whois চেক করে দেখবেন সফল হয়েছে কিনা। না হলে আমাদের জানাবেন। রেজিষ্ট্রেশন ট্রান্সফার ও রিনিউ সফল না হলে আমরা এর দায় নিবোনা।

৭.৫. ডোমেইন রিনিউঃ ডোমেইন রিনিউ তারিখের ২১ দিন আগে ইনভয়েস তৈরী হবে। রিনিউ তারিখের ১৪, ৭ দিন আগে মেইল যাবে অথবা হোয়াটসঅ্যাপে মেসেজ যাবে। রিনিউ তারিখের আগেই পেমেন্ট করতে হবে। না করলে ডোমেইন ক্যান্সেল করা হবে। ডোমেইনটি প্রয়োজন না হলে ক্যান্সেল রিকুয়েষ্ট করতে পারবেন।

৭.৬. রিনিউএর বিস্তারিতঃ সম্ভব হলে রিনিউ তারিখের ৭ দিন বা তারও আগে পেমেন্ট করে রিনিউ করে নিন। whois চেক করুন সফলভাবে রিনিউ হয়েছে কিনা। না হলে অবশ্যই আমাদের জানান।

৭.৭. ডোমেইন ট্রান্সফার ও মালিকানাঃ ডোমেইন ট্রান্সফার হয়ে আপনার একাউন্টে আসলে আপনিই এই ডোমেইনের মালিক। whois ডাটাবেইজ আপনার প্রোফাইলের ডিটেইলস নিবে। Whois চেক করে আপনার সঠিক তথ্য নিশ্চিত করুন। নাহলে যেকেউ আপনার ডোমেইন দখল করতে পারে।

৭.৮. ডোমেইন ট্রান্সফারের নিওমঃ ডেট শেষ হওয়ার ১৫ দিনের মধ্যে ট্রান্সফার করে নেয়া উত্তম। ট্রান্সফার করার জন্য অথরাইজেশন কোড ও ডোমেইন আনলক থাকতে হবে। ডোমেইন ট্রান্সফার করলে বর্তমান মেয়াদের সাথে ১ বছর যোগ হবে।

৭.৯. ডোমেইন ট্রান্সফারের সীমাবদ্ধতাঃ আমাদের এখানে ট্রান্সফার করে আনার সময়, বর্তমান রেজিট্রারার কোম্পানি যদি ট্রান্সফারের অনুমতি না দেয় তাহলে ট্রান্সফার ফেইল হবে। এক্ষেত্রে আমরা দায়ী থাকবো না। ট্রান্সফার সফল না হলে আমাদের জানান, আমরা আপনার টাকা রিফান্ড করে দিব। ডোমেইন রেজিট্রেশনের ২ মাসের মধ্যে ট্রান্সফার করা যায়না। কিছু ডোমেইনের ট্রান্সফারের লিমিটেশন রয়েছে। তাই বার বার ট্রান্সফার করতে পারবেন না। পেমেন্ট করার পরে ডোমেইন ট্রান্সফার প্রসেস শুরু হবে।

৭.১০. ডোমেইনের মেয়াদোত্তীর্ণঃ ডোমেইনের মেয়াদ শেষ হওয়ার ৩ দিন পরে এটি কাজ করা বন্ধ করে দিবে এবং নেমসার্ভার পরিবর্তন হয়ে যাবে। তাই ডোমেইনের মেয়াদ শেষ হওয়ার আগেই পেমেন্ট করতে হবে। কিছু ডোমেইন প্রভাইডার গ্রেস পিরিয়ডে রাখে। ডোমেইন মেয়াদোত্তীর্ণ হলে এটি গ্রেস / রিডামশন পিরিয়ডে চলে যাবে। তখন এই ডোমেইন রেজিট্রেশন করা যাবেনা। ১ – ৩ মাস বা তারও বেশি গ্রেস পিরিয়ডে থাকতে পারে। এসময় জরিমানা দিয়ে তা পুনরুদ্ধার করা যাবে।

ডোমেইন এক্সপায়ার্ড হলে অথবা গ্রেস পিরিয়ড শেষ হলে রেজিট্রারার নিচের পদক্ষেপ নিতে পারেঃ

1. ডোমেইন নিলাম করে বিক্রি করতে পারে
2. ডোমেইন রেজিট্রেশনের জন্য মুক্ত করে দিবে
3. অথবা বেশি দামে বিক্রির জন্য রেখে দিবে।

ডোমেইনের রিনিউয়ের সময় শেষ হলে আমরা যদি রিনিউ চার্জ না পাই, তাহলে ডোমেইনের জন্য আমরা আর দায়বদ্ধ থাকবো না। গ্রেস / রিডামশন পিরিয়ডে যাওয়ার পরে আপনি যদি ডোমেইন পুনরুদ্ধার করতে চান, তাহলে আমরা রেজিট্রি কোম্পানিকে রিকুয়েষ্ট করে দেখতে পারি। যদি পুনরুদ্ধার করার অপশন থাকে, তার জন্য আমরা আপনাকে সাহায্য করবো। তবে আমাদের দায়িত্ব থাকবে না। তখন রিডামশন চার্জ + রিনিউ চার্জ দিয়ে পুনরুদ্ধার করতে হবে। তবে আমরা গ্যারান্টি দিবোনা যে এটা সম্ভব হবে।

৮. হোস্টিং :

৮.১. ফ্রি ডোমেইন অফারঃ আমাদের কিছু হোস্টিং প্যাকেজে ডোমেইন রেজিট্রেশন ও ট্রান্সফার অফার রয়েছে। কি কি ডোমেইন এক্সটেনশন রেজিট্রশন বা ট্রান্সফার করতে পারবেন তা আমাদের থেকে জেনে নিন এবং অর্ডার করার সময়ও দেখতে পাবেন। ফ্রি ডোমেইন সবসময় দেয়া হবে কিনা তা আমরা বিবেচনা করবো। সীমিত কিছু এক্সটেনশন এলাউ করা হয় এবং প্যাকেজ ভেদে তা আলাদা হতে পারে। অন্যান্য ডোমেইন এক্সটেনশন নিতে চাইলে এক্সট্রা ফি যোগ হবে। কত যোগ হবে তা এক্সটেনশনের উপর নির্ভর করবে এবং ফ্রি ডোমেইনের চার্জটা মাইনাস করা যাবে। রেজিট্রশন পিরিয়ড ১ বছর বা লাইফটাইম (যদি হোস্টিং প্যাকেজ রিনিউ করেন)। রিনিউ করার সময়, রেগুলার ডোমেইন রিনিউ চার্জ প্রযোজ্য হবে।

৮.২. হোস্টিং সার্ভিসঃ ওয়েবসাইট হোস্ট ও ইমেইল সার্ভিসের জন্য হোস্টিং ব্যবহার করা যাবে। ব্যাচ প্রসেসিং, ভিডিও এনকোডিং/ট্রান্সকোডিং, ওয়েব ক্রলিং/স্পাইডারিং, আর্কাইভিং এবং অনলাইন ব্যাকআপ সিস্টেম বা অন্য কোনো সিস্টেম আমাদের শেয়ার্ড, ক্লাউড বা রিসেলার হোস্টিং সার্ভার অনুমোদিত নয়। আপনি শুধুমাত্র একটি ডেডিকেটেড সার্ভারে আমাদের সাথে লিখিতভাবে চুক্তির পরে এই ধরনের টুলস ব্যবহার করতে পারেন। আমরা আমাদের সিস্টেমের স্মুথ পারফরম্যান্স বজায় রাখতে সমস্ত ক্লায়েন্টদের জন্য যেকোন পদক্ষেপ নেওয়ার অধিকার রাখি। ইসলামিক আইন ও বাংলাদেশি আইনে পর্নোগ্রাফি নিষিদ্ধ তাই যেকোন পর্নোগ্রাফি ওয়েবসাইট / ছবি / ভিডিও / ব্লগ সার্ভারে রাখা নিষিদ্ধ।

৮.৩. হোস্টিং লিমিটেশনঃ কিছু প্যাকেজে “আনলিমিটেড হোস্টিং” রয়েছে। যার অর্থ আপনি সক্রিয়ভাবে আপনার অ্যাকাউন্টের ডিস্ক স্পেস বা ব্যান্ডউইথ (বা উভয়ই) আনলিমিটেড ব্যবহার করতে পারবেন। তবে সেয়ার্ড, ক্লাউড, রিসেলার হোস্টিং এ Ram, CPU বা এধরনের রিসোর্সের লিমিট থাকে। তবে ডেডিকেটেড সার্ভারে লিমিট করাই থাকে, তার মধ্যে সীমাবদ্ধ থাকতে হয়।

৮.৪. আনলিমিটেড ব্যবহারঃ আনলিমিটেড মেমরি ও ব্যান্ডউইথ ব্যবহার করা যাবে। অত্যাধিক ব্যবহার হলে সার্ভার ক্যাপাসিটি আরো বাড়ানো হবে। তবে এভারেজে যদি কোন ক্লায়েন্ট অত্যাধিক ব্যবহার করে সেক্ষেত্রে কিছু চার্জ যোগ হতে পারে।

৮.৫. মাইগ্রেশন সার্ভিসঃ ফ্রি মাইগ্রেশন সার্ভিসে আপনার ওয়েবসাইট বা ফুল সিপ্যানেল পূর্ববর্তী কোম্পানির হোস্টিং থেকে ফ্রি ট্রান্সফার করে দেয়া হয়। ওয়েবসাইট যেখানেই থাক আমরা ট্রান্সফার করে দিতে পারি কোন ডেটা লস ছাড়াই। তবে আপনাকে পূর্ববর্তী হোস্টিং সার্ভিসের সম্পূর্ণ এক্সেস দিতে হবে। আমরা ২ থেকে ৭২ ঘন্টার মধ্যে সমস্ত ওয়েবসাইট মাইগ্রেট করে থাকি। তবে আমরা কোন সময় গ্যারান্টি দিইনা। আপনার ওয়েবসাইট কত বড় বা কত ফাইল আছে তার উপর সময় নির্ভর করে। কিছু ক্ষেত্রে আমরা ইমেল, ডিএনএস রেকর্ড এবং ডোমেন নামগুলিও স্থানান্তর করতে পারি, তবে আমরা কোন গ্যারান্টি দিই না যে আমরা সেগুলি সফলভাবে বা বাধা ছাড়াই স্থানান্তর করতে পারবো। এটি পূর্ববর্তী হোস্টিং কোম্পানির উপর নির্ভর করে।

যে প্যাকেজে ফ্রি মাইগ্রেশন সার্ভিস নাই সে প্যাকেজে মাইগ্রেশন করতে চাইলে এক্সট্রা চার্জ দিতে হবে। প্রতিটা সিপ্যানেল ২৫০ টাকা বা 2.5 USD চার্জ আসবে।

৮.৬. হোস্টিং পরিবর্তনঃ আপনার ওয়েবসাইট যে হোস্টিংএ চলছে তা পরিবর্তন করার অধিকার আমরা সংরক্ষণ করি। এই পরিবর্তনগুলি হতে পারে সার্ভার লোকেশন, ক্লাউড কোম্পানি অথবা কনফিগারেশন পরিবর্তন। শুধুমাত্র প্রয়োজন পড়লেই হোস্টিং আপগ্রেড করা হবে। হোস্টিং এর যে কোনো পরিবর্তন করলে এনাউন্সমেন্ট ফেসবুক পেজ, মেইল অথবা হোয়াটসঅ্যাপে জানানো হবে। পরিবর্তনের কারন হতে পারে –

আরো বেটার সার্ভিস প্রদানের জন্য এই পরিবর্তন করা হতে পারে। সিকিউরিটি হুমকি থাকলে ক্লাউড কোম্পানি পরিবর্তন করা হতে পারে। যদি বর্তমান লোকেশন ক্লাউড কোম্পানি বন্ধ করে দেয়। যদি লোকেশনে যুদ্ধ শুরু হয়।

মুলত পরিবর্তন হয় সার্ভার লোকেশন ও ক্লাউড প্রভাইডার। আপনার পছন্দের কোন সার্ভার লোকেশন অথবা ক্লাউড প্রভাইডার থাকলে তা আমাদের জানাতে পারেন। পরিবর্তন করা সম্ভব হবেনা, যদি পছন্দের লোকেশন আর না থাকে অথবা বন্ধ হয়ে যায়।

আমরা বিবেচনা করে একটা ভালো প্রভাইডার বা লোকেশন দিব। (যেমন মাইক্রোসফট এজিউর এর কেপ টাউন ডেটাসেন্টার থেকে মাইক্রোসফট এজিউ এর জোহানেসবার্গ ডেটাসেন্টার অথবা AWS বাহরাইন থেকে আলিবাবা বাহরাইন)।

৮.৭. আপস্ট্রিম প্রভাইডারঃ আমাদের আপস্ট্রিম প্রভাইডারের পরিষেবা শর্তাবলীর সাথে সম্মত হতে হবে। যেমনঃ আপনার ব্যবহৃত সফ্টওয়্যার ডিজিটাল ওশান ক্লাউড প্রভাইডারের হলে মার্কিন যুক্তরাষ্ট্রে লাইসেন্সপ্রাপ্ত হতে হবে।

৮.৮. CDN এবং ব্যান্ডউইথ ব্যবহারঃ কিছু জায়গায় যেখানে সংযোগের দাম ও ব্যান্ডউইথের দাম বেশি থাকে (যেমন মধ্যপ্রাচ্য, বাংলাদেশ) বা ওঠানামা করে, সেখানে আমরা আপনাকে CDN পরিষেবা প্রদান করবো। CDN পরিষেবা একক সার্ভারের পরিবর্তে বিশ্বব্যাপী ট্র্যাফিক বিতরণ করে, এইভাবে ওয়েবসাইটের লোডের গতি বাড়ায় এবং উৎস থেকে ব্যান্ডউইথ খরচ কমায়৷ আমরা এটি সেটআপে আপনাকে সহায়তা করব।

৮.৯. যে ক্ষেত্রে গ্যারান্টি নাইঃ হোস্টিং পরিষেবাতে হাই সিকিউরিটি দেয়া রয়েছে। তবে আক্রমণ থেকে আপনার ওয়েবসাইটকে রক্ষা করার জন্য আমরা কোনও গ্যারান্টি দিই না, যদি না সেই পরিষেবাটি বিশেষভাবে আলোচনা করে (এক্সট্রা চার্জ) দেওয়া হয়। আপনি যদি মনে করেন যে আপনার ওয়েবসাইট DDOS টার্গেটেড, তাহলে আপনার ক্লাউডফ্লেয়ারের মত তৃতীয় পক্ষ থেকে একটি DDOS পরিষেবা কেনা উচিত।

৮.১০. হোস্টিং আপটাইমঃ আমরা পরিকল্পিত, জরুরী সার্ভার রক্ষণাবেক্ষণ বা আমাদের সার্ভার আপগ্রেডের বাইরের শর্তগুলি বাদে ৯.৯৯% আপটাইম দেওয়ার চেষ্টা করি। পরিকল্পিত সার্ভার আপগ্রেড, মেইনটেইনের ক্ষেত্রে যদি ৩০ মিনিটের বেশি সময় লাগে তাহলে ফেসবুক পেজ, ওয়েবসাইট এনাউন্সমেন্ট অথবা ইমেইলে জানিয়ে দেয়া হবে। আপনার সার্ভারে কোন সমস্যা হলে আমরা আমাদের দক্ষ সার্ভার ডেভেলপার দ্বারা ৩০ মিনিটের মধ্যে সমাধান দেয়ার চেষ্টা করবো। আপনার সমস্যাটি বিস্তারিত জানালে তা সমাধান হতে আনুমানিক কত সময় লাগবে জানিয়ে দিব।

৮.১১. সার্ভিসে ব্যাঘাতঃ আমাদের নিয়ন্ত্রণের বাইরের পরিষেবাগুলিতে ব্যাঘাতের জন্য আমরা দায়ী নই। তবে আমরা এমন সার্ভার প্রদানকারী বাছাই করার চেষ্টা করি যেগুলি অত্যন্ত উচ্চ স্তরের কর্মক্ষমতাসম্পন্ন এবং আপটাইম অফার করে। কিন্তু যদি পরিষেবা সরবরাহ আমাদের নিয়ন্ত্রণের বাইরের কোনো বিষয় দ্বারা ব্যাহত হয়, তাহলে আমরা আপনাকে জানানোর জন্য যত তাড়াতাড়ি সম্ভব আপনার সাথে যোগাযোগ করব এবং এই ব্যাঘাতের প্রভাব কমানোর জন্য পদক্ষেপ নেব।

ব্যাঘাত ঘটলে ফেসবুক স্টাটাস বা ক্লাইন্ট এরিয়ার এনাউন্সমেন্টে জানানো হবে। আপস্ট্রিম নেটওয়ার্ক বা হার্ডওয়্যার সমস্যার জন্য আমরা দায়ী থাকব না। যেমন AWS এর কোনো সমস্যা হলে আমরা তাদের সমস্যার জন্য দায়ী থাকব না বা আমাদের 99.9% আপটাইম গণনার মধ্যে এটি অন্তর্ভুক্ত করব না।

৯. চুক্তির অধীনে আপনার বাধ্যবাধকতা :

৯.১. স্ক্রিপ্ট, ছবি, ভিডিও ও যেকোন কন্টেন্টের সম্পূর্ণ দায় দায়িত্ব ক্লায়েন্টের। নাল ক্রাক স্ক্রিপ্ট যা আমাদের সিষ্টেমে হস্তক্ষেপ করে ও অন্যদের ক্ষতি করে, যেকোন প্রতারণামূলক কার্যকালাম থাকলে একাউন্ট বন্ধ করে এ বিষয়ে তদন্ত করা হবে এবং স্থায়ীভাবে বন্ধ করা হবে। ক্লাইন্টকে এ বিষয়ে সহযোগিতা করা হবে।

৯.২. অবশ্যই লিগ্যাল স্ক্রিপ্ট কন্টেন্ট ব্যবহার করতে হবে এবং এ ধরনের কন্টেন্ট আপলোড দেয়া থেকে বিরত থাকতে হবেঃ আক্রমণাত্মক, অপমানজনক, অশ্লীল, মানহানিকর, ভীতিকর। সার্ভারের অবস্থান যেখানে যেমন সিঙ্গাপুর, USA, সেখানের সরকারি রুলস মানতে হবে এবং সার্ভার মালিক ও এই সার্ভারে ইন্টারনেট যে ISP (ইন্টারনের সার্ভিস প্রভাইডার) প্রভাইড করছে তাদের রুলসের সাথেও একমত হতে হবে। এটি নিশ্চিত করার একমাত্র দায়িত্ব ব্যবহারকারীর। অবৈধ উপকরণ সংরক্ষণ, বিতরণ বা সংক্রমণ সংশ্লিষ্ট কর্তৃপক্ষের দ্বারা তদন্ত এবং সম্ভাব্য বিচার হতে পারে। বিশেষ করে আপনিঃ

যেকোনো উদ্দেশ্যে কোনো কম্পিউটার সিস্টেমে অন-অনুমোদিত অ্যাক্সেস লাভ বা লাভ করার চেষ্টা করা উচিত নয়। এই ধরনের পদক্ষেপ কম্পিউটার অপব্যবহার আইনের অধীনে ফৌজদারি মামলা হতে পারে।
জাল ঠিকানা বা ডেটা ব্যবহার করে ইন্টারনেটে ডেটা পাঠাবেন না এবং এমন স্ক্রিপ্ট রাখা যাবে না যা ইচ্ছাকৃতভাবে রিমোট ডিভাইসগুলোতে প্রভাবিত করার জন্য ডিজাইন করা হয়েছে। (যেমন DDoS, ওয়ার্ম এবং ভাইরাস, ট্রোজান এবং পিং স্টর্ম)
নিশ্চিত করতে হবে যে লোকাল পিসি ও নেটওয়ার্ক কানেক্টেড সার্ভার ওপেন রিলে ও বাল্ক মেইল মেসেজ পাঠাবে না। এটি স্প্যাম হিসেবে ধরা হয়
রিমোট সিস্টেম বা নেটওয়ার্কের দুর্বলতা যাচাই, স্ক্যান, পরীক্ষা বা অ্যাক্সেস করার উদ্দেশ্যে ‘পোর্ট স্ক্যানিং’ বা অন্যান্য সফ্টওয়্যার চালানো নিষিদ্ধ। এমন পরিস্থিতিতে যেখানে রিমোট ব্যবহারকারী এটি করার জন্য স্পষ্ট অনুমতি দিয়েছেন। আমরা এই ধরনের অনুমতির প্রমাণ চাইতে পারি।
আপনার লগিন তথ্য পাসওয়ার্ড ইউজারনেম গোপন রাখতে হবে।
ইলিগ্যাল জিনিসপত্র যেমন কপিরাইট কন্টেন্ট, হ্যাকিং টুলস ইত্যাদি প্রেরণ ও গ্রহণ করা থেকে বিরত থাকতে হবে। আপনি যা করছেন তার বৈধতা সম্পর্কে আপনার সন্দেহ থাকলে বা তা কেউ করার প্রস্তাব করলে, আপনাকে আইনি পরামর্শ নিতে হবে।
কোনো অবস্থাতেই প্রক্সি সার্ভার খোলার অনুমতি নেই এবং এর ফলে পরিষেবা অবিলম্বে বন্ধ হয়ে যাবে
সাইটগুলিতে ‘বিদ্বেষপূর্ণ’ উপাদান বা বিষয়বস্তু রাখা উচিত নয় যা ঘৃণাকে উসকে দিতে চায়।
সাইটগুলিতে পর্নোগ্রাফির চিত্র, ভিডিও, চিত্রণ বা বর্ণনা থাকা উচিত নয় যা বেআইনি বা যা আমাদের নিজস্ব বিবেচনার ভিত্তিতে অপছন্দনীয় বলে মনে করা হয়।
সাইটগুলিতে কপিরাইটযুক্ত সঙ্গীত/ভিডিও বা এই ধরনের সামগ্রীর লিঙ্ক থাকা উচিত নয়। তাদের ওয়েবসাইটে প্রদর্শিত যেকোনো বিষয়বস্তু বিতরণ করার অধিকার তাদের আছে কিনা তা নিশ্চিত করা ব্যবহারকারীর দায়িত্ব।
সাইটগুলিকে অবশ্যই স্বীকৃত আন্তর্জাতিক কপিরাইট আইন মেনে চলতে হবে।

৯.২. ডোমেইন নাম নিবন্ধনঃ প্রত্যক্ষ বা পরোক্ষভাবে একটি ডোমেইন নামের নিবন্ধন এবং এটি কিভাবে ব্যবহার করা হবে তা নিশ্চিত করার জন্য আপনি দায়বদ্ধ। ICANN এর পরিষেবার সাথে একমত হতে হবে এবং কোন সময় কোন বেআইনী উদ্দেশ্যে ব্যবহার করা যাবে না।

একটি নিবন্ধিত ডোমেনের মালিকানা অন্য ব্যক্তির কাছে হস্তান্তর / বিক্রি করার সময় নিশ্চিত করবেন এবং প্রমাণ করবেন যে ক্রেতা আমাদের এই চুক্তির শর্তাবলীর সাথে একমত ও লিখিতভাবে সম্মত।

আমরা একটি ডোমেনের মালিকানা হস্তান্তর করব না যতক্ষণ না অ্যাকাউন্টের সাথে সম্পর্কিত পরিষেবাগুলির সমস্ত ফি পরিশোধ করা না হবে।

ট্রেডমার্ক/ব্র্যান্ড লঙ্ঘনের বিষয়ে আমরা কোন অভিযোগ পেলে, আমাদের ডোমেইন হোল্ড রাখার অধিকার আছে। ডোমেন বিরোধ নিষ্পত্তি অথবা সংশ্লিষ্ট পক্ষের মধ্যে একটি নিষ্পত্তি চুক্তি থেকে সিদ্ধান্ত প্রাপ্ত হলে আমরা সেই অনুযায়ী ব্যবস্থা নেব৷ সেক্ষেত্রেও রিনিউয়াল ডেট আসলে রিনিউয়াল ফি আপনার আমাদের প্রদান করতে হবে।

আমরা ডোমেইনটি হোল্ড রাখবো এবং ততক্ষণ পর্যন্ত এটি সরাবো না যতক্ষণ এটি নিষ্পত্তি হচ্ছে এবং প্রদানকৃত ডকুমেন্টে আমরা সন্তুষ্ট হচ্ছি।

১০. গ্রহণযোগ্য ইমেল ব্যবহার :

SMTP ব্যবহার করে ই-মেইল পাঠানো হয়। এটি প্রতিদিনের যোগাযোগের প্রয়োজনে ডিজাইন করা হয়েছে। সমস্ত আউটবাউন্ড মেল একটি ক্লাউড-ভিত্তিক স্প্যাম ফিল্টারিং সিস্টেম দ্বারা স্ক্যান করা হয়৷

স্প্যামের বিরুদ্ধে আমাদের জিরো-টলারেন্স নীতি রয়েছে এবং বাল্ক, অযাচিত ই-মেইল পাঠানো সব সময়ে নিষিদ্ধ। যে গ্রাহকরা ইমেল পরিষেবার অপব্যবহার করেন তাদের জানানো হচ্ছে যে, তাদের আচরণ অগ্রহণযোগ্য এবং তাদের অ্যাকাউন্টগুলি সাসপেন্ড, বন্ধ বা ব্লক করা হতে পারে।

১০.১. পরিষেবাগুলি ক্রয় করে আপনি নিম্নলিখিত নীতিগুলি সাথে সম্মত হবেনঃ

• কোনো প্রাপকের বিরক্তি, অসুবিধা বা উদ্বেগের কারণ হতে পারে এমন ইমেল না পাঠানো।
• বিরক্তিকর, অশ্লীল, অশ্লীল, ভীতিকর বা যে কোনও উপায়ে বেআইনি এমন কোনও ইমেল বা কষ্টের কারণ হতে পারে এমন কোনও ইমেল প্রেরণ না করা;
• সমস্ত নিউজলেটার যোগাযোগে একটি স্পষ্ট নীতি থাকা;
• বাল্ক (সাধারণত ‘স্প্যাম’ নামে পরিচিত) বা স্বতন্ত্রভাবে অযাচিত ইমেল পাঠাতে আমাদের মেল পরিষেবা বা নেটওয়ার্ক ব্যবহার না করা;
• অন্যদের পরিষেবা থেকে বঞ্চিত করার উদ্দেশ্যে আমাদের মেল পরিষেবা বা নেটওয়ার্ক ব্যবহার না করা (‘মেইল বোমা’);
• মিথ্যা মেইল হেডার ব্যবহার না করা বা মেল বার্তার শিরোনামগুলি এমনভাবে পরিবর্তন করা যাতে প্রেরকের পরিচয় গোপন করা যায়;
• আপনি ব্যবহার করার জন্য অনুমোদিত নন এমন কোনো ইমেল ঠিকানা ব্যবহার করবেন না;
• আমাদের নেটওয়ার্কের সাথে সংযুক্ত এবং আপনার দ্বারা পরিচালিত কোনো ইমেল সার্ভার ‘ওপেন রিলে’-এর অনুমতি দেওয়ার জন্য কনফিগার করা হয়নি তা নিশ্চিত করতে;

১০.২. আপনার নিজের ইমেলের সম্পূর্ণ দায়িত্ব আপনার। সাধারণ ডেটা সুরক্ষা প্রবিধান বা ডেটা সুরক্ষা আইন 2018-এর অধীনে আপনাকে বা আমাদের বাধ্যবাধকতা লঙ্ঘন করতে পারে এমন কোনও পদক্ষেপ না নেওয়া।

১১. গ্রহনযোগ্য ব্যবহার নীতি :

ক্লায়েন্ট অ্যাকাউন্টে ওয়েবস্পেস প্রদান করে থাকি। আমরা গ্রাহকদের দেয়া কোনও ওয়েব স্পেসের বিষয়বস্তু নিরীক্ষণ করি না (সেটা শেয়ার্ড, ক্লাউড বা রিসেলার হোস্টিং হোক না কেন)। আমরা আপনার ওয়েবসাইটের বিষয়বস্তুর জন্য কোন দায়বদ্ধতা বহন করি না।
আপনার মালিকানাধীন বা পরিচালিত যেকোন ওয়েবসাইটের বিষয়বস্তু এবং উপকরণগুলি আপনার তৈরি করা বা ব্যবহারের অনুমতি আছে কিনা তা নিশ্চিত করা আপনার একমাত্র দায়িত্ব।
আপনার ওয়েবসাইট বা ওয়েব পরিষেবার সাথে যুক্ত কপিরাইট বা ইলিগ্যাল যে কোনও বিরোধের সমাধান করা আপনার একমাত্র দায়িত্ব।

আপনি সম্মত হন যে আপনি পরিষেবাগুলি ব্যবহার করবেন না:

• যে কোনো প্রযোজ্য স্থানীয়, রাজ্য বা ফেডারেল আইন বা প্রবিধান লঙ্ঘন করে, যার মধ্যে কোনো কপিরাইট, ট্রেডমার্ক, পেটেন্ট, অ্যান্টি-পাইরেসি, বা অন্যান্য বৌদ্ধিক সম্পত্তি আইন বা প্রবিধান, বা কোনো রপ্তানি নিয়ন্ত্রণ বা শিশু পর্নোগ্রাফি আইন, বা উত্সাহিত করা সহ কিন্তু সীমাবদ্ধ নয়। অন্যদের এই ধরনের আইন বা প্রবিধান লঙ্ঘন করতে সক্ষম করুন।
• তথ্য, সফ্টওয়্যার বা উপাদানে প্রেরণ, বিতরণ, প্রকাশ, পোস্ট, সঞ্চয়, লিঙ্ক বা অন্যথায় ট্র্যাফিক যা:
• শিশু পর্নোগ্রাফি, চাইল্ড ইরোটিকা, পাশবিকতা, বা অ-সম্মতিমূলক যৌন ক্রিয়াকলাপ বা অন্যথায় অশ্লীলতার সাথে যে কোনও উপায়ে গঠন, চিত্রিত, প্রতিপালন, প্রচার বা সম্পর্কযুক্ত।
• মাদক সম্পর্কিত ওয়েবসাইট
• অ্যালকোহল/ওয়াইন সম্পর্কিত ওয়েবসাইট
• প্রাপ্তবয়স্ক/যৌন সম্পর্কিত
• বেআইনি কার্যকলাপ বা মাদকের ব্যবহার, অত্যধিক সহিংসতা বা নিষ্ঠুরতা, বা পঞ্জি-টাইপ স্কিমকে উৎসাহিত করে, মহিমান্বিত করে, উস্কে দেয় বা প্রচার করে।
• প্রতারণামূলক বা ফিশিং, হ্যাকিং, বা পরিচয় চুরি, বা তৃতীয় পক্ষের পরিচয় ছদ্মবেশী করার প্রচেষ্টার সুবিধা দেয়৷
• তৃতীয় পক্ষের ব্যবসা, বুদ্ধিবৃত্তিক সম্পত্তি, চুক্তিভিত্তিক, গোপনীয়তা, বা বিশ্বস্ত অধিকার লঙ্ঘন করে বা ভুলভাবে বাণিজ্য গোপনীয়তা বা অন্যান্য গোপনীয় বা মালিকানাধীন তথ্য প্রকাশ করে।
• দূষিত অ্যাপ্লিকেশন বা যেকোনো ধরনের কোড রয়েছে।
• কম্পিউটার, সার্ভার, বা নেটওয়ার্ক আক্রমণ বা ব্যাঘাতের যে কোনো রূপ তৈরি করে বা সহজতর করে।
• মানহানিকর, মানহানিকর, হুমকি, হয়রানিমূলক বা অপমানজনক।
• যেকোন ধরনের মেইল-বোমা বা স্প্যাম পাঠান, পোস্ট করুন, হোস্ট করুন, সক্ষম করুন বা সুবিধা দিন (“স্প্যাম” যেকোন ধরনের অযাচিত ই-মেইল হিসাবে সংজ্ঞায়িত করা হয়)।
• ওপেন প্রক্সি বা ইন্টারনেট রিলে চ্যাট (IRC) ব্যবহার করুন বা প্রদান করুন।
• যেকোনো ধরনের সার্ভার বা অন্যান্য সার্ভার অ্যাপ্লিকেশন হোস্ট করুন যেগুলি পরিষেবা অস্বীকার (DDoS) আক্রমণ বা অন্যান্য ধরণের আক্রমণের ঘন ঘন লক্ষ্য।
• ব্যক্তিগত তথ্য সংগ্রহ করুন যেমন ইমেল ঠিকানা, স্ক্রিন নাম বা অন্যান্য ব্যক্তিগতভাবে শনাক্তযোগ্য তথ্য যাতে চিহ্নিত করা হয়েছে সেই পক্ষের সম্মতি ছাড়াই।

এই ধরনের ক্ষেত্রে, NameEver কোনো পূর্ব নোটিশ ছাড়াই অবিলম্বে গ্রাহক অ্যাকাউন্টটি বন্ধ করার অধিকার সংরক্ষণ করে।

১২. পেমেন্ট বিষয় :

আপনি যখন আমাদের কোনো পণ্য এবং পরিষেবার অর্ডার করেন, আপনি একটি প্রি-পেইড পরিষেবা কিনছেন। স্বয়ংক্রিয় পেমেন্ট গেটওয়ে বা ম্যানুয়াল পেমেন্ট সিস্টেম ব্যবহার করে সমস্ত পেমেন্ট অগ্রিম প্রদান করা হবে। পুনর্নবীকরণের নোটিশ পুনর্নবীকরণ তারিখের 15 দিন আগে থেকে ইমেলের মাধ্যমে কিছু বার পাঠানো হবে। আপনি যদি শেষ নবায়নের তারিখে পরিষেবাটি পুনর্নবীকরণ করতে অক্ষম হন তবে আপনার হোস্টিং এবং ডোমেন স্থগিত করা হবে এবং আমরা কোনও ডেটা ক্ষতির জন্য দায়ী নই। ওয়েব হোস্টিং পরিকল্পনার জন্য আমরা কোনো অর্থ প্রদান ছাড়াই আপনার অ্যাকাউন্ট সেটআপ করব। আমরা নিরাপদ লেনদেনের জন্য পেমেন্ট গেটওয়ে ব্যবহার করে অর্থ প্রদান করার পরামর্শ দিই। আমরা সব ধরনের ডেবিট, ক্রেডিট, ভিসা এবং মাস্টারকার্ড গ্রহণ করি। এছাড়াও মোবাইল ব্যাংকিং গ্রহণ করুন (বিকাশ, রকেট এবং নগদ)। আমরা কোনো ধরনের ভার্চুয়াল কার্ড গ্রহণ করি না। কখনও কখনও আপনার পেমেন্ট যাচাই করার জন্য আমাদের আপনার কাছ থেকে কিছু নথির প্রয়োজন হয়। তাই আপনাকে আমাদের সাথে সহযোগিতা করতে হবে।

১৩. অন্যান্য গুরুত্বপূর্ণ শর্তাবলী :

১৩.১. দামের পরিবর্তনঃ আমরা যে কোনো সময় আমাদের ওয়েবসাইটে বিজ্ঞাপন দেওয়া মূল্য এবং ফি পরিবর্তন করার অধিকার সংরক্ষণ করি। আমরা আপনার অ্যাকাউন্ট নিবন্ধন করার সময় আপনার দ্বারা প্রদত্ত ইমেল ঠিকানায় ইমেলের মাধ্যমে যেকোনো পরিবর্তনের লিখিত বিজ্ঞপ্তি প্রদান করব। বেশিরভাগ ক্ষেত্রে, নতুন গ্রাহকদের জন্য ওয়েবসাইটে মূল্য পরিবর্তন করা হয় এবং বিদ্যমান গ্রাহকদের জন্য মূল্যকে প্রভাবিত করবে না। যদি আপনার চুক্তি একটি নির্দিষ্ট মেয়াদের জন্য হয়, তাহলে মূল্য পরিবর্তন বর্তমান মেয়াদের শেষে এবং পুনর্নবীকরণের সময় কার্যকর হবে।

১৩.২. অর্থ পরিশোধ না করলে ৩ দিন পরে সার্ভিসটি সাময়িকভাবে বন্ধ হয়ে যাবে এবং ১৪ দিন পরে স্থায়ীভাবে বন্ধ হয়ে যাবে। পেমেন্ট ডেট শেষ হওয়ারের পরে এই ১৪ দিনের মধ্যে পেমেন্ট করলে সার্ভিস আবার চালু হয়ে যাবে। এক্ষেত্রে কোন সুদ বা লেটফি প্রদান করতে হবেনা। স্থায়ীভাবে বন্ধ হলে সমস্ত ডেটা ডিলিট হয়ে যাবে এবং আর পুনরুদ্ধার করা যাবেনা।

১৩.৩. আমাদের দ্বারা ক্ষতিগ্রস্ত হলে বা ক্ষতির জন্য আমাদের দায়বদ্ধতাঃ

আমাদের দ্বারা সৃষ্ট সম্ভাব্য ক্ষতির জন্য আমরা আপনার কাছে দায়বদ্ধ। যদি আমরা এই শর্তাবলী মেনে চলতে ব্যর্থ হই, তাহলে আপনার ক্ষতির জন্য আমরা দায়ী যা আমাদের এই সার্ভিস চুক্তি ভঙ্গের কারন হবে। আপনি আপনার পুরা টাকা ফেরত নিতে পারবেন।

তবে আমরা যে ক্ষতির জন্য দায়ী নই তার ধারণা দেয়া হলঃ মনে করুন USA তে আমাদের সার্ভার রয়েছে এবং সেখানে যুদ্ধ শুরু হবে, তা অনুমানযোগ্য হলে আমাদের ডেটা সেখান থেকে অন্য সার্ভারে সরিয়ে নিব। কিন্তু নেটা যদি অনুমানযোগ্য না হয় তাহলে আমরা এর জন্য দায়ী থাকবো না।

আমরা আপনার প্রতি আমাদের দায়বদ্ধতাকে বাদ দিই না বা সীমাবদ্ধ করি না কারন এটি করা বেআইনি হবে। এর মধ্যে আমাদের অবহেলা বা আমাদের কর্মচারী, এজেন্ট বা সাব-কন্ট্রাক্টরদের অবহেলার কারনে ভুল উপস্থাপনের কারণে ব্যক্তিগত বুলবোঝাবুঝির দায় অন্তর্ভুক্ত রয়েছে।

ব্যবসায়িক ক্ষতির জন্য আমরা দায়ী নই। আপনি যদি কোনও বাণিজ্যিক, ব্যবসায়িক বা পুনঃবিক্রয়ের উদ্দেশ্যে পণ্যগুলি ব্যবহার করেন তবে লাভের ক্ষতি, ব্যবসার ক্ষতি, ব্যবসায় বাধা বা ব্যবসার সুযোগ হারানোর জন্য আপনার কাছে আমাদের কোনও দায় থাকবে না।

1. Buy Sell:

Please read these terms carefully before ordering any product. These Terms witness your binding to these Terms.

2. Delivery time:

Customers can order all products displayed on our website. All hosting information will be sent to customer’s registered email upon purchase of hosting.

3. Refund Policy:

To cancel your hosting services and receive a refund, you must contact us within 7 days of the effective date of the specific services you wish to cancel. Only newly purchased hosting fees are refundable. Set up, SSL certificate, dedicated IP, renewal payments, suspension due to misuse of resources and other one-time fees are non-refundable. If we transfer your site the site transfer fee will be deducted from your refund. If your bandwidth usage is more than 5 GB then the money back policy will not be applicable. Refund/Money back policy is not applicable for any VPS/dedicated server and domain registration. Any promotional offer/price will not be applicable for refund.

Improper or illegal activity. If your account is found to contain illegal activities, illegal mp3 files, pirated software, hacker programs, warez programs or any other illegal files, your account will be suspended immediately. Failure to remove offensive content will result in termination of your account. No money back guarantee or refund will be applicable in this case.
Money back will be refunded within 7 working days of receiving the money back request.

4. Return Policy:

Can cancel shared hosting, premium hosting or corporate hosting, reseller hosting, VPS plan. Contact support to cancel. Or make a cancel request from My Account. Service will be canceled within 24 hours. All data will be deleted after actively canceling the service.

Note: Domain registration, domain transfer, free domain with hosting, any type of offer plan, reseller hosting, master reseller hosting and managed VPS can be canceled or terminated. Refunds are not available. Credits to your account are non-refundable.

5. After Sales Service:

Terms of Service and until the expiration of the service period after the transfer of our service or product We provide full support as per the contract.

6. Service Order:

6.1 How do we accept orders?
After placing the order, the service fee must be paid first, then we will provide the service. Placing an order on the website does not guarantee that we will accept your order. We will verify your information and accept your order. If you provide incorrect information, your order will be canceled and your money will be refunded.
6.2. Account creation:
Account must be created before ordering or at the time of ordering. Registration should be done with name, address, email, phone number and password. Keep your password secret. If you suspect that someone else is logging into your account, contact us immediately.

7. Domain:

7.1. After buying domain, verification mail will go to your mail, verification link will go to mail. Verify by clicking on the link. Failure to verify may result in domain suspension.
You can manage your domain from the NameEver client area. Provide Whois information correctly. Incorrect information can get your domain banned. Host Blue shall not be liable in such case.

7.2. Change of Registry Company: We may change the registrar without notice in order to provide the best service. If the domain transfer mail goes after you pay the renew charge, you must approve it. This change will not affect your domain.

7.3. Third Party Terms of Service: All gTLDs are registered and transferred from an ICANN authorized registrar company. You must agree to ICANN’s Terms of Service. We register from the registry company so must also agree to their terms of service.

7.4. Your preferred domain may not be available. In that case look at other domains. Connecting to our site registry company. Sends our website to the registry company for domain registration, transfer and renewal. After registration, transfer and renewal, check Whois to see if successful. If not, let us know. We will not be responsible if the registration transfer and renewal is not successful.

7.5. Domain Renewal: Invoice will be generated 21 days prior to domain renewal date. 14, 7 days before the renewal date, mail or WhatsApp message will be sent. Payment must be made before the renewal date. Otherwise the domain will be cancelled. You can cancel the domain if you don’t need it.

7.6. Renewal Details: If possible, renew by making payment 7 days or before the renewal date. Check whois is renewed successfully. If not, definitely let us know.

7.7. Domain transfer and ownership: You are the owner of this domain when it comes to your account through domain transfer. The whois database will take your profile details. Verify your correct information by checking Whois. Otherwise anyone can grab your domain.

7.8. Terms of domain transfer: It is best to transfer within 15 days of the due date. Must have authorization code and domain unlock for transfer. Transferring the domain will add 1 year to the current term.

7.9. Domain Transfer Restrictions: At the time of our transfer here, the transfer will fail if the current registrar’s company does not allow the transfer. In this case we will not be responsible. If the transfer is not successful, let us know and we will refund your money. Domain cannot be transferred within 2 months of registration. Some domains have transfer limitations. So you can’t transfer again and again. Domain transfer process will start after payment.

7.10. Domain Expiration: After 3 days of domain expiration, it will stop working and nameservers will be changed. So payment must be made before the domain expires. Some domain providers put in grace periods. When the domain expires it will go into grace / redemption period. Then this domain cannot be registered. There may be a grace period of 1 – 3 months or more. It can be recovered by paying a fine.

If the domain expires or the grace period ends, the registrar can take the following steps:

1. Can sell domains by auction
2. Free for domain registration
3. Or put it up for sale at a higher price.

If we do not receive a renewal charge after the domain’s renewal period has expired, we are no longer responsible for the domain. If you want to recover the domain after going through the grace / redemption period, we can make a request to the registry company. If there is an option to restore, we will help you with that. But we will not be responsible. Then redemption charge + renew charge has to be recovered. However, we do not guarantee that this will be possible.

8. Hosting:

8.1. Free Domain Offer: Some of our hosting packages include domain registration and transfer offers. Find out from us what domain extension registration or transfer you can do and also see when to order. We will consider whether the free domain will always be provided. A limited number of extensions are allowed and may vary by package. Additional fees will be charged for other domain extensions. How much will be added depends on the extension and can be minus the free domain charge. Registration period is 1 year or lifetime (if renewing hosting package). At the time of renewal, regular domain renewal charges will apply.

8.2. Hosting service: Hosting can be used for website host and email service. Batch processing, video encoding/transcoding, web crawling/spidering, archiving and online backup systems or any other systems are not permitted on our shared, cloud or reseller hosting servers. You may use such tools only upon agreement with us in writing on a dedicated server. We reserve the right to take any action for all clients to maintain the smooth performance of our systems. Pornography is prohibited in Islamic law and Bangladeshi law so putting any pornographic website / image / video / blog on server is prohibited.

8.3. Hosting Limitations: Some packages have “unlimited hosting”. Which means you can actively use your account’s disk space or bandwidth (or both) unlimited. However, shared, cloud, reseller hosting has a limit of RAM, CPU or such resources. However, there is a limit to the dedicated server, it has to be limited.

8.4. Unlimited Usage: Unlimited memory and bandwidth can be used. Server capacity will be further increased in case of heavy usage. But on average some charges may be added if a client uses too much.

8.5. Migration Service: Free migration service provides free transfer of your website or full cPanel from previous hosting company. We can transfer the website wherever it is located without any data loss. But you have to give full access to previous hosting service. We migrate all websites within 2 to 72 hours. However, we do not guarantee any time. The time depends on how big your website is or how many files it has. In some cases we may also transfer emails, DNS records and domain names, but we make no guarantees that we will be able to transfer them successfully or without interruption. It depends on the previous hosting company.

If you want to migrate to a package that does not have free migration service, you will have to pay an extra charge. Each Cpanel will charge 250 Taka or 2.5 USD.

8.6. Hosting changes: Your websiteWe reserve the right to change the hosting. These changes can be server location, cloud company or configuration changes. Hosting will be upgraded only when required. Any change in hosting will be announced on Facebook page, mail or WhatsApp. Reasons for change may be –

These changes may be made to provide better service. The cloud company may be changed if there is a security threat. If the current location closes the cloud company. If the battle starts at the location.

The main changes are server location and cloud provider. Let us know if you have a preferred server location or cloud provider. Changes will not be possible if the preferred location no longer exists or has been closed.

We will consider a good provider or location. (eg Microsoft Azure’s Cape Town datacenter to Microsoft Azure’s Johannesburg datacenter or AWS Bahrain to Alibaba Bahrain).

8.7. Upstream Providers: We must agree to the terms of service of our upstream providers. For example, if the software you use is from a Digital Ocean cloud provider, it must be licensed in the United States.

8.8. CDN and Bandwidth Usage: In some locations where connection costs and bandwidth costs are high (eg Middle East, Bangladesh) or fluctuate, we will provide you with CDN services. CDN services distribute traffic globally rather than to a single server, thus speeding up website loading and reducing bandwidth consumption at the source. We will help you setup it.

8.9. In cases where there is no guarantee: High security is provided in the hosting service. However, we do not make any guarantees to protect your website from attacks, unless that service is offered by special negotiation (extra charge). If you think your website is DDOS targeted, you should purchase a DDOS service from a third party like CloudFlare.

8.10. Hosting Uptime: We strive to provide 9.99% uptime, excluding conditions outside of planned, emergency server maintenance or our server upgrades. In the case of planned server upgrade, maintenance, if it takes more than 30 minutes, it will be notified on Facebook page, website announcement or email. If there is any problem on your server, we will try to solve it within 30 minutes by our skilled server developers. If you tell me the details of your problem, I will give you an estimate of how long it will take to solve it.

8.11. Service Interruptions: We are not responsible for service interruptions beyond our control. But we try to choose server providers that offer very high level of performance and uptime. But if the provision of the Service is disrupted by any matter beyond our control, we will contact you as soon as possible to inform you and take steps to minimize the impact of this disruption.

Disruptions will be announced on Facebook status or client area announcements. We are not responsible for upstream network or hardware problems. As such we will not be responsible for any issues with AWS or include them in our 99.9% uptime calculation.

9. YOUR OBLIGATIONS UNDER THE AGREEMENT:

9.1. Scripts, images, videos and any content are the sole responsibility of the client. Null Crack Scripts that interfere with our system and harm others, any fraudulent activities will be investigated and permanently terminated by account closure. The client will be assisted in this regard.

9.2. Must use legal script content and refrain from uploading such content: offensive, abusive, obscene, defamatory, threatening. The government rules of the location of the server, such as Singapore, USA, must be followed and must also be agreed with the rules of the server owner and the ISP (internet service provider) providing the internet to the server. It is the user’s sole responsibility to ensure this. Storage, distribution or transmission of illegal materials may result in investigation and possible prosecution by the relevant authorities. Especially you:

Must not gain or attempt to gain unauthorized access to any computer system for any purpose. Such actions may lead to criminal prosecution under the Computer Misuse Act.
Don’t send data over the Internet using fake addresses or data, and don’t host scripts that are designed to intentionally affect remote devices. (eg DDoS, Worms and Viruses, Trojans and Ping Storms)
Ensure that local PCs and network connected servers do not send open relay and bulk mail messages. This is considered spam
Running ‘port scanning’ or other software for the purpose of probing, scanning, testing or accessing remote system or network vulnerabilities is prohibited. In situations where the remote user has given express permission to do so. We may ask for proof of such permission.
Your login information password username must be kept secret.
Refrain from sending and receiving illegal content such as copyrighted content, hacking tools, etc. If you have any doubts about the legality of what you are doing or someone is proposing to do, you should seek legal advice.
Under no circumstances are proxy servers allowed to open and result in immediate service bwill be dark
Sites should not contain ‘hateful’ material or content that seeks to incite hatred.
The Sites must not contain images, videos, depictions or descriptions of pornography that are illegal or that are deemed objectionable in our sole discretion.
Sites should not contain copyrighted music/videos or links to such content. It is the user’s responsibility to ensure that they have the right to distribute any content displayed on their website.
Sites must comply with recognized international copyright laws.

9.2. Domain Name Registration: You are responsible for ensuring, directly or indirectly, the registration of a domain name and how it is used. ICANN’s services must be agreed upon and may not be used for any illegal purpose at any time.

When transferring / selling ownership of a registered domain to another person ensure and prove that the buyer agrees and agrees in writing with the terms of this agreement.

We will not transfer ownership of a domain until all fees for services associated with the account have been paid.

If we receive any complaint regarding trademark/brand infringement, we reserve the right to put the domain on hold. We will act accordingly if a decision is obtained from domain dispute resolution or a settlement agreement between the parties concerned In that case, you have to pay us the renewal fee on the renewal date.

We will hold the domain and not move it until it is settled and we are satisfied with the documents provided.

10. Acceptable email usage:

E-mail is sent using SMTP. It is designed for daily communication needs. All outbound mail is scanned by a cloud-based spam filtering system

We have a zero-tolerance policy against spam and sending bulk, unsolicited e-mail is prohibited at all times. Customers who abuse email services are advised that their behavior is unacceptable and their accounts may be suspended, terminated or blocked.

10.1. By purchasing the Services you agree to the following policies:

• Not sending emails that may cause annoyance, inconvenience or concern to any recipient.
• not to send any email that is harassing, obscene, obscene, threatening or unlawful in any way or any email that may cause distress;
• Have a clear policy on all newsletter communications;
• not use our mail service or network to send unsolicited email in bulk (commonly known as ‘spam’) or individually;
• not use our mail service or network with the intention of depriving others of service (“mail bombs”);

10.2. You are solely responsible for your own email. Not to take any action that may breach your or our obligations under the General Data Protection Regulations or the Data Protection Act 2018.

11. Acceptable Use Policy:

We provide webspace to client accounts. We do not monitor the content of any web space provided to customers (whether shared, cloud or reseller hosting). We bear no responsibility for the content of your website.
It is your sole responsibility to ensure that you have permission to create or use the content and materials on any website you own or operate.
It is your sole responsibility to resolve any copyright or illegal disputes associated with your website or web services.

You agree that you will not use the Services:

• Violates any applicable local, state or federal laws or regulations, including any copyright, trademark, patent, anti-piracy, or other intellectual property laws or regulations, or any export control or child pornography laws, or encourages but not limited Enable others to violate such laws or regulations.
• Transmit, distribute, publish, post, store, link or otherwise traffic in information, software or material that:
• Constitutes, depicts, promotes, promotes or relates in any way to child pornography, child erotica, brutality, or non-consensual sexual activity or is otherwise obscene.

In such case, NameEver reserves the right to terminate the customer account immediately without any prior notice.

12. Payment Subject:

When you order any of our products and services, you are purchasing a pre-paid service. All payments will be made in advance using automated payment gateways or manual payment systems. Renewal notices will be sent by email no later than 15 days prior to the renewal date. If you are unable to renew the service on the last renewal date, your hosting and domain will be suspended and we are not responsible for any data loss. We’ll setup your account for the web hosting plan at no charge. We recommend paying using a payment gateway for secure transactions. We accept all types of Debit, Credit, Visa and MasterCard. Also accept Mobile Banking (Development, Rocket and Cash). We do not accept virtual cards of any kind. Sometimes we need some documents from you to verify your payment. So you need to cooperate with us.

13. Other Important Terms:

13.1. Price Changes: We reserve the right to change the prices and fees advertised on our website at any time. We will provide written notice of any changes by email to the email address you provided when registering your account. In most cases, price changes are made on the website for new customers and will not affect prices for existing customers. If your contract is for a fixed term, the price change will be effective at the end of the current term and upon renewal.

13.2. In case of non-payment, the service will be suspended after 3 days and permanently after 14 days. Payment within these 14 days after the expiry of the payment date will restart the service. In this case no interest or late fee has to be paid. Permanent shutdown will delete all data and cannot be recovered.

13.3. OUR LIABILITY FOR DAMAGES OR DAMAGES DAMAGED BY US:

We are liable to you for any possible damages caused by us. If we fail to comply with these Terms, we are liable for any damages you incur that would result in our breach of this Service Agreement. You can get your full money back.
